A declaration of unconstitutionality or illegality with generally binding force shall take effect as of the moment at which the rule declared unconstitutional or illegal came into force, and shall cause the revalidation of such rules as the said rule may have revoked. [Article 282(1)]

La décision de non-conformité à la Constitution ou la décision d'illégalité est revêtue de l'autorité absolue de la chose jugée. Elle produit ses effets dès l'entrée en vigueur de la norme déclarée non conforme ou illégale et si cette dernière est abrogatoire, les dispositions auparavant abrogées sont à nouveau applicables. [Article 282-1]
