On condition that the rules laid down by properly ratified international treaties are applied in the legal system of the other party thereto, the unconstitutionality in form or substance of such rules shall not prevent their application in the Portuguese legal system, save if such unconstitutionality results from the breach of a fundamental provision of this Constitution. [Article 277(2)]

La non-conformité organique ou formelle de traités internationaux régulièrement ratifiés ne fait pas obstacle à l'application de leurs normes dans l'ordre juridique portugais, dès lors que de telles normes sont appliquées dans l'ordre juridique de l'autre partie, à moins que la non-conformité résulte d'une violation d'une disposition de la loi fondamentale. [Article 277-2]
